General Terms and Conditions

These Terms and Conditions govern the relationship between the School of Regenerative Educators (SRE) and anyone who registers for, purchases, or participates in an SRE course, resourcing engagement, or membership to the Developmental Community. By registering or making payment, you agree to these terms. These terms are also included in all invoices and registration confirmation emails.

2. Applicability

These Terms and Conditions apply to all agreements between SRE and participants, schools, institutions, or other contracting parties (hereinafter: 'the Client'), including:

  • Enrolment in a course, training programme or intensive offered by SRE

  • Engagement of resourcing services

  • Subscription to an SRE membership such as the Developmental Community

In the event of a conflict between these terms and any specific agreement, the specific agreement shall prevail. These terms are governed by Dutch law. Any disputes shall be submitted to the competent court in the district of Utrecht.

 

3. Agreement and Enrolment

An agreement between SRE and the Client is established at the moment the Client pays for an offering or accepts an offering in writing, whichever occurs first. This constitutes a binding contract.

Registration or enrolment for a course, resourcing engagement, or membership constitutes acceptance of these Terms and Conditions in full.

SRE reserves the right to refuse or cancel a registration if the Client does not meet the stated prerequisites for a programme, if the Client does not work according to regenerative principles as outlined on the SRE website or if enrolment is no longer possible due to capacity constraints.

 

4. Response Times and Communication

SRE aims to respond to all enquiries, registration requests, and communications within 14 calendar days.

Information about SRE's offerings, including programmes, dates, pricing, and brochures, is made available via the SRE website and upon request. SRE reserves the right to update this information at any time. The Client is encouraged to verify current details before registering.

All formal communication (invoicing, confirmation of registration, cancellation notices) will be sent to the email address provided by the Client at the time of registration.

 

5. Pricing and Payment

5.1 Invoicing

SRE invoices upfront for courses, offerings or membership period. For resourcing, we send an invoice depending on agreements made with the Client. This can take three forms: 50% upfront, and 50% after the work has been completed. On a monthly basis. Or 100% after the work has been completed. The latter option is only available up to 5000 euros. 

5.2 Payment Term

Invoices must be paid within 30 calendar days of the invoice date, unless a different arrangement has been agreed in writing (see 5.1).

5.3 Late Payment

If payment is not received within the agreed term, SRE reserves the right to suspend access to the programme or service until payment is received. SRE may also charge statutory interest (wettelijke rente) and any reasonable costs incurred in collecting the outstanding amount.

5.4 VAT / BTW

SRE applies for educational BTW exemption under Article 11(1)(o) of the Dutch VAT Act (Wet OB 1968). Where this exemption applies, no VAT will be charged. Where the exemption does not apply, the applicable VAT rate will be stated on the invoice.

 

6. Cancellation and Refund

6.1 Cooling-Off Period (Consumer Clients)

If the Client is an individual (not acting in a professional or business capacity), they have the right to withdraw from the agreement within 14 calendar days of registration, without giving any reason, in accordance with the EU Consumer Rights Directive and Dutch consumer law (Boek 6 BW).

To exercise this right, the Client must notify SRE in writing at school@regenerative-educators.com within the 14-day period. SRE will process any refund within 14 calendar days of receiving the cancellation notice.

Note: if the Client expressly requests the programme to begin within the cooling-off period and the programme has commenced, the right of withdrawal is forfeited.

6.2 Cancellation After the Cooling-Off Period

Cancellations received after the 14-day cooling-off period, but more than 14 days before the start of the programme, will be eligible for a 50% refund of the amount paid.

Cancellations received after the 14-day cooling-off period, but 14 days or fewer before the start of the programme will not be eligible for any refund.

All cancellation requests must be submitted in writing to school@regenerative-educators.com.

6.3 Refund Processing

Where a refund is due, SRE will process it within 14 calendar days of confirming the cancellation. Refunds will be made via the original payment method, unless otherwise agreed.

7. Cancellation by SRE

SRE reserves the right to cancel a course or programme if fewer than 10 participants have registered, unless otherwise specified for the programme in question. In such cases, the Client will be notified at least 14 days before the scheduled start date.

If SRE cancels a programme under these circumstances, the Client will receive a full refund within 14 calendar days of the cancellation notice. SRE is not liable for any additional costs (such as travel or accommodation) incurred by the Client as a result of a cancellation.

SRE may also cancel or postpone a programme in cases of force majeure (overmacht), including illness of the trainer, extreme weather, or government-imposed restrictions. In such cases, SRE will make reasonable efforts to reschedule and will offer the Client the choice to transfer their registration or receive a refund.

8. Confidentiality

Both SRE and the Client agree to treat all information shared in the context of the programme or engagement as confidential, where that information is of a sensitive or non-public nature.

Specifically:

  • SRE's trainers, facilitators, and staff will not disclose personal or professional information shared by participants to third parties, except where required by law.

  • SRE maintains the legal rights to materials produced during, for, and in educational offerings offered by the SRE, including the ability to use this for further development of its offerings (including but not limited to publications such as books, articles, podcasts, video’s). Materials will only be used in an anonymized way in line with the Dutch guidelines for research. 

  • Participants are expected to respect the confidentiality of fellow participants. Personal stories, experiences, or viewpoints shared within the learning space are not to be shared outside that space without explicit consent.

  • Any confidential information shared by SRE with the Client (including unpublished materials, methodologies, or internal documents) remains the property of SRE and may not be reproduced, distributed, or shared without prior written consent.

This confidentiality obligation continues to apply after the end of the programme or engagement.

 

9. Use of SRE Materials

All course materials, documents, frameworks, exercises, and other content provided by SRE, whether in digital or physical form, are developed by SRE and are made available for the personal, non-commercial use of registered participants only.

Without prior written permission from SRE, participants and clients may not:

  • Reproduce, copy, or distribute SRE materials to third parties for commercial purposes or without proper attribution of the materials

  • Use SRE materials in their own teaching, training, or consultancy work for commercial purposes or without proper attribution of materials

  • Publish or share SRE materials publicly, including via social media or online platforms for commercial purposes or without proper attribution of the materials

Materials shared by participants during a programme (such as presentations, reflections, or professional examples) remain the property of those participants. SRE maintains the rights to use participant-generated materials for analysis, research, and further development of the core knowledge of the SRE on regenerative educatorship. 

 

10. Copyright and Intellectual Property

All intellectual property rights in SRE's content, publications, website, books, frameworks, and course materials vest in the School of Regenerative Educators (or in its partners and collaborators where applicable), and are protected under Dutch and European copyright law.

SRE's first publication, The Art of Regenerative Educatorship, and all associated frameworks and tools are copyright protected. Participants who purchase or receive access to this or any other SRE publication may use it for personal and professional development only.

Any use beyond personal development, including citation in academic or professional publications, requires written attribution and, where applicable, written permission from SRE.

 

11. Privacy

11.1 SRE's Handling of Participant Data

SRE processes personal data in accordance with the General Data Protection Regulation (GDPR / AVG) and Dutch privacy law. SRE collects only the personal data necessary to administer registrations, deliver programmes, and communicate with participants.

Personal data (such as name, email address, and professional information) will not be shared with third parties without the participant's consent, except where required by law or strictly necessary for the delivery of the programme (for example, sharing names with a co-facilitator).

Participants may request access to, correction of, or deletion of their personal data at any time by contacting school@regenerative-educators.com. SRE will respond within 30 days.

11.2 Privacy Between Participants

Programmes delivered by SRE often involve group settings in which participants share personal or professional experiences. All participants are expected to treat the personal information of fellow participants with care and respect.

Recording of sessions, whether audio, video, or otherwise, is not permitted without the explicit prior consent of all participants and SRE. SRE maintains the right to make recordings for the purposes of analysis, research, communication and further development of the field of regenerative education. 

Participant contact details shared within the learning community are provided for community purposes only and may not be used for commercial or unsolicited communications.

 

12. Liability

SRE's liability for damages arising from the performance of its services is limited to the amount paid by the Client for the relevant programme or engagement.

SRE is not liable for indirect damages, consequential losses, or damages resulting from force majeure. SRE is also not liable for loss or damage to personal property brought to in-person sessions by participants.

The Client remains personally responsible for their own wellbeing and for any decisions made as a result of participating in an SRE programme.

 

13. Changes to These Terms

SRE reserves the right to amend these Terms and Conditions at any time. The most current version will always be available at www.regenerative-educators.com and will be included in registration communications.

If changes are made after an agreement has been entered into, the version of the Terms in force at the time of registration will continue to apply to that agreement, unless both parties agree otherwise in writing.

 

14. Complaints Procedure

SRE takes all complaints seriously and is committed to handling them promptly, fairly, and with care. If you are dissatisfied with any aspect of our services, we encourage you to raise this with us directly so we can work towards a resolution together.

14.1 Submitting a Complaint

Complaints must be submitted in writing to school@regenerative-educators.com. Please include a clear description of the complaint, the relevant dates, and any supporting information. SRE will acknowledge receipt of your complaint within 5 working days and will provide a substantive response within 4 weeks of receipt.

14.2 Who Handles Your Complaint

Depending on the nature of your complaint, it will be handled by the most appropriate person within SRE:

  • Developmental Community (DC) matters — Bas van den Berg

  • SRE course matters — Koen Wessels

  • Resourcing engagements — Mieke Lopes Cardozo

14.3 Independent Resolution — Council of Elders

If a complaint cannot be resolved through direct dialogue with the relevant contact person, either party may refer the matter to SRE's Council of Elders. The Council of Elders acts as an independent third party within the SRE community and is empowered to facilitate a fair, considered resolution of disputes. The judgment of the council of elders is binding and will be swiftly handled by SRE.

14.4 External Recourse

If you remain unsatisfied after the internal complaints procedure has been completed, you retain the right to submit your complaint to the competent court in the district of Utrecht (The Netherlands), or to any other legally recognised dispute resolution body.

14.5 Registration of complaints

Complaints and their resolution will be registered internally by SRE and will be deleted one year after resolution. 

 

15. Participation at Own Risk

Participation in any SRE offering, resourcing engagement, or membership is at the participant's own risk. SRE creates a carefully held and supportive learning environment, but cannot be held responsible for any physical, emotional, or professional consequences that may arise from participation. Participants are encouraged to take responsibility for their own wellbeing and to communicate any relevant needs or concerns to SRE prior to or during the programme.
